3. Eligibility and Registration

3.1 Age Requirements

You must be 13 years or older to use our platform. Users under 18 must obtain verifiable consent from a parent or legal guardian before using the Website or Services. We reserve the right to request proof of age or parental consent at any time.

3.2 Account Registration

Registration is required to access many features of our platform. By creating an account, you:

4. Services and Payments

4.1 Service Description

TeachForge.ai provides online educational services including but not limited to:

  • Live one-to-one tutoring sessions
  • Group tutoring sessions
  • Pre-recorded educational content
  • Interactive learning materials and assessments
  • Educational resources and support

We make no guarantee regarding specific educational outcomes or results.

4.2 Service Availability

While we strive to provide uninterrupted service, we do not guarantee that the Services will be available at all times. We reserve the right to suspend, modify, or discontinue any aspect of the Services at any time.

4.3 Payment Terms

  • All fees are quoted in British Pounds (GBP) and are inclusive of applicable VAT
  • Payment is required in advance for all Services
  • You authorize us to charge the payment method you provide for all Services
  • All payment obligations are non-cancelable and fees paid are non-refundable except as expressly provided in these Terms

4.4 Pricing and Fee Changes

We reserve the right to change our prices at any time. Any price changes will be communicated to you and will apply to future Services only.

4.5 Refunds and Cancellations

  • Cancellations made more than 24 hours before a scheduled Session may receive a full refund or credit
  • Cancellations made less than 24 hours before a scheduled Session are not eligible for refunds
  • If a Tutor cancels or fails to attend a Session, the Student will receive a full refund or credit
  • Technical issues originating from our platform that prevent completion of a Session may qualify for partial refunds or credits at our discretion
  • Subscription plans and package purchases have specific refund terms as detailed at the time of purchase
  • We reserve the right to issue refunds or credits at our sole discretion

5. User Conduct and Content

5.1 Acceptable Use

You agree to use our Services only for lawful purposes and in accordance with these Terms. You shall not:

  • Engage in or promote any unlawful, abusive, discriminatory, or harmful behavior
  • Harass, bully, or intimidate any User or staff member
  • Impersonate another person or misrepresent your identity or affiliations
  • Upload or transmit malware, viruses, or any malicious code
  • Attempt to breach our security measures or gain unauthorized access to any part of the Platform
  • Conduct any activity that may impair or interfere with the operation, security, or integrity of the Website

5.2 User Content

All Content provided through the Platform is owned by TeachForge.ai or its licensors and is protected under the Copyright, Designs and Patents Act 1988 and other applicable intellectual property laws. This includes but is not limited to:

  • Educational materials and methodology
  • Software and technology underlying the Services

6.2 Limited License to Users

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Services and Content for personal, non-commercial educational purposes only. You may not:

TEACHFORGE.AI AND ITS SUPPLIERS EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

  • THE SERVICES WILL MEET YOUR SPECIFIC REQUIREMENTS
  • THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
  • THE RESULTS OBTAINED FROM THE USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE
  • THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED THROUGH THE SERVICES WILL MEET YOUR EXPECTATIONS
  • ANY ERRORS IN THE SERVICES WILL BE CORRECTED

7.2 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TEACHFORGE.AI, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES
  • ANY CONTENT OBTAINED FROM THE SERVICES
  • UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT

REGARDLESS OF WHETHER SUCH DAMAGES ARE BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

OUR TOTAL LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR FROM THE USE OF OR INABILITY TO USE THE SERVICES SHALL NOT EXCEED THE AMOUNTS YOU HAVE PAID TO TEACHFORGE.AI FOR USE OF THE SERVICES DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO SUCH LIABILITY.

THE LIMITATIONS OF DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN TEACHFORGE.AI AND YOU.

Any educational advice, materials, or assessments provided through our Platform are for informational purposes only. They do not constitute formal academic or professional advice. Users should consult with appropriate educational institutions or professionals for specific guidance.

7.4 Third-Party Links and Content

8. Term and Termination

8.1 Term

These Terms shall remain in full force and effect while you use the Services or maintain an account with us.

8.2 Termination by You

You may terminate your account at any time by following the instructions on our Website or by contacting us. Termination of your account does not relieve you of any payment obligations incurred prior to termination.

8.3 Termination by Us

We reserve the right, without notice and in our sole discretion, to terminate your access to and use of the Services, including:

  • If we believe your actions may cause legal liability for you, other users, or TeachForge.ai

  • You must cease all use of the Services
  • Any fees paid are non-refundable unless expressly stated otherwise
  • Provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability

9. Disputes and Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

9.2 Dispute Resolution

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AND TEACHFORGE.AI EACH WAIVE THE RIGHT TO PARTICIPATE AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING.

10. Additional Provisions

10.1 Entire Agreement

These Terms, together with our Privacy Policy, Safeguarding Statement, and any other legal notices published by TeachForge.ai on the Services, constitute the entire agreement between you and TeachForge.ai concerning your use of the Services.

10.2 Waiver and Severability
